NEW RELEASE MOVIE RENTAL AGREEMENT
1-Day DVD rentals are due back by 9PM on the day after rental begins. Additional per day charge applies if not returned when due. If rental is not returned within 30 days, rental will be deemed lost or stolen and customer is responsible for the replacement cost of the rental. If customer chooses No Late Fees option at time of rental, additional per day charges will not apply. On 8th day after the rental due date, unreturned rentals are converted to sales and charged to Member's account at selling price at the time of rental. If the rental is returned in re-saleable condition between the 8th and 30th day past due date, a $1.75 re-stocking fee will apply and the account will be credited for the amount of the sale. ROGERS RETAIL RENTAL AGREEMENT
The following terms and conditions shall govern the rental of movies, games and all other forms of media and related equipment ("Media and/or Equipment") that are available to be rented from Rogers Communications Partnership ("Rogers").

MEMBERSHIP RIGHTS AND RESPONSIBILITIES

1. Customer Information. By completing the Rogers membership application process, you, the membership applicant, agree that the information you are providing to Rogers for the purpose of completing this application is true and correct. Further, you acknowledge and agree that the information you provide to Rogers may be used by Rogers' affiliate and subsidiary entities for any lawful marketing or promotional purposes. If, at any time, you wish to withdraw such consent, please complete the "Opt Out" form that will be made available to you on request.

2. Additional Members. You may authorize additional members of your immediate family ("Additional Members") to rent Media and/or Equipment using your own membership account ("Account"), but such authorization must be done by you in person, by providing the names of the Additional Members to a Rogers customer service representative. By authorizing Additional Members to use your Account, you agree to be liable for all rental fees as well as all extended viewing charges, damage charges and lost charges incurred by any Additional Member.

3. Identification. You and any Additional Member renting Media and/or Equipment from Rogers must provide membership identification by way of a valid Rogers membership card or, in the absence of the membership card, other identification that is acceptable to the Rogers customer service representatives in their sole discretion.

4. Damage to Media/Equipment. Should you or any Additional Member return the Media and/or Equipment or its container in damaged condition, the cost of repair or replacement ("damage charge") will be charged to your Account.

5. No Late Fees on Movies. All rentals are due back by the time and date stamped on your receipt. However, if you keep any movie rental for more than 7 days after the due date printed on your receipt, Rogers will automatically convert your movie rental to a retail sale. On such 'sale date' (the 8th day after the end of the rental period), Rogers will post the selling price of the item to your membership account as of the date of the initial rental. The amount charged to your account will be calculated as follows: a) If the product was not available for sale to the general public at that store as a 'previously-rented movie' at the time of the initial rental, the amount charged will be the original full sale price. b) If the product was available for sale at that store as a 'previously rented movie' at the time of the initial rental, the amount charged will be the selling price for the previously-rented product. If you return the item within 30 days of the original rental due date in re-saleable condition, Rogers will credit your membership account with the amount previously charged.

6. Extended Viewing Charges. Should you or any Additional Members fail to return any non-movie rental by the end of the rental period shown on your receipt, an additional charge ("extended viewing charge") will be levied against your Account based on the then-current rental rate specified in the rental rate materials posted at each Rogers store (the "Rental Rates Material").

7. Lost Charges. Should you or any Additional Members fail to return any non-movie rental within thirty days of the time it was due to be returned (as set out in the Rental Rates Material), such Media and/or Equipment will be deemed to have been lost or stolen and you shall be liable for the payment of all costs in relation to its recovery or replacement and for any additional late payments ("lost charges") at the then-current rate specified in the Rental Rates Material.

8. Lost or Stolen Cards. If your membership card is lost or stolen, you are liable for all charges incurred through the use of the card until its return to Rogers or receipt by Rogers of notice (delivered in writing or in person) of its loss or theft. If this card is lost or stolen, contact your local Rogers store immediately.

9. Collections. You acknowledge that the information provided by you may be disclosed to a collection agency for the purpose of collecting any outstanding rental or sales fees, extended viewing charges, or damage charges.

10. Amendments. Rogers reserves the right to change its rental rates and all other terms and conditions of this Rental Agreement upon posting notices of any such changes at its Rogers stores or on its web-site www.rogersplus.ca (aka rogers.com/plus). If you do not accept any such changes, you must cancel your membership by returning your membership card in person. By continuing to rent Media and/or Equipment following such a change, you and any Additional Member shall be deemed to have accepted such changes.

11. Indemnification. You and any Additional Members using your Account agree to adhere to all conditions set out in this agreement. Further, you agree to indemnify and hold Rogers harmless from and against all losses, damages, costs, charges and expenses which Rogers may sustain, incur or be liable to, for or in consequence of, your or any Additional Members' non-compliance with the conditions set out in this agreement.

12. Arbitration. Any claim, dispute or controversy (whether in contract or in tort, pursuant to statute or regulation, or otherwise, and whether pre-existing, present or future) arising out of or relating to: (a) this Rental Agreement; (b) the Media and/or Equipment provided by Rogers; (c) oral or written statements, or advertisement or promotions relating to this Rental Agreement or the Media and/or Equipment; (d) the relationships which result from this Rental Agreement (collectively, a "Claim"), will be resolved by arbitration to the exclusion of the courts. You agree to waive any right you may have to commence or participate in any class action against us related to any claim and, where applicable, you also agree to opt out of any class proceeding against us. Please give notice of any Claim in writing to Rogers, Unit #100, 10991 Shellbridge Way, Richmond, B.C., V6X 3C6. Arbitration will be conducted by one arbitrator pursuant to the laws and rules relating to commercial arbitration in the province in which you reside or, alternatively, the province in which you rented the Media and/or Equipment, in either case in Rogers's discretion and local legislation.
